ARTICLE 3 – PRODUCTS
3.1 Characteristics
The essential characteristics of each product are presented on its product page before an order is placed.
The customer is encouraged to read, in particular, the ingredients, pack size, instructions for use and any precautions for use.
Photographs, illustrations and visual elements aim to represent the products as faithfully as possible. However, slight variations in presentation or colour may occur, in particular due to the screens used or changes to the packaging.
3.2 Cosmetic nature of the products
ADEPSIA products marketed as cosmetic products are intended for skin care, maintenance and comfort.
They are not medicines and are not intended to diagnose, prevent, treat or cure a disease.
The customer must use the products in accordance with the instructions and precautions stated on their packaging and/or product page.
3.3 Availability
Products are offered subject to stock availability.
In the exceptional event that a product is unavailable after an order has been confirmed, ADEPSIA will inform the customer as soon as possible.
If the order cannot be fulfilled, the unavailable product will be refunded using the payment method used when placing the order.
ARTICLE 4 – PRICES
The applicable prices are those displayed on adepsia.fr when the order is confirmed.
They are stated in euros.
As ADEPSIA currently benefits from the VAT exemption scheme, VAT is not charged in accordance with Article 293 B of the French General Tax Code.
Any delivery costs are stated separately before final confirmation of the order.
ADEPSIA may change its prices at any time. Any price change has no effect on an order that has already been confirmed.
Promotional codes and commercial offers apply only during their validity period and in accordance with any conditions specified when they are presented.
ARTICLE 5 – ORDERING
The customer selects the products they wish to order and adds them to their basket.
Before finally confirming their order, they can check:
- the selected products;
- the quantities;
- the price;
- any discounts;
- the delivery costs;
- the delivery address;
- the delivery method;
- the total order amount.
The customer is responsible for the accuracy of the information they provide.
Final confirmation of the order entails an obligation to pay.
A confirmation is sent to the email address provided by the customer.
ADEPSIA reserves the right to refuse or suspend an order for a legitimate reason, in particular in the event of a declined payment, reasonable suspicion of fraud or clearly incorrect information that prevents the order from being processed.
ARTICLE 6 – PAYMENT
The price of the order is payable when the order is confirmed.
The available payment methods are presented to the customer directly at checkout.
Electronic payments are processed, in particular, through Shopify and the payment providers enabled on the shop.
ADEPSIA does not directly retain the full banking details of cards used to make payments.
The order is considered paid after the relevant provider has confirmed payment.
If payment is declined, the order may be automatically cancelled.
ARTICLE 7 – DELIVERY
7.1 Delivery areas
ADEPSIA delivers to the destinations offered to the customer when placing their order.
At launch, the delivery methods offered may include, in particular:
Colissimo for home delivery;
Mondial Relay for delivery to a Point Relais collection point or Locker.
The services actually available are those displayed at the time of the order.
7.2 Delivery address
Products are delivered to the address provided by the customer when placing their order or to the selected Point Relais collection point.
The customer is responsible for the accuracy of their address and the information required for delivery.
ADEPSIA cannot be held responsible for an inability to deliver directly caused by clearly incorrect or incomplete information provided by the customer, without prejudice to their statutory rights.
7.3 Delivery costs
Delivery costs are stated before final confirmation of the order.
They may vary according to the destination, carrier, delivery method, parcel weight and order value.
Free delivery may be offered where the conditions displayed on the website are met.
7.4 Delivery times
The applicable estimated delivery date or period is communicated to the customer before or when they place their order.
Where no specific delivery period has been stated, ADEPSIA delivers the product without unjustified delay and no later than the deadline provided for by applicable regulations.
7.5 Delivery to a Point Relais collection point
When the customer chooses Mondial Relay or any other delivery service to a Point Relais collection point, they must select an available collection point.
The customer is responsible for collecting the parcel during the availability period communicated by the carrier.
When a parcel is returned to ADEPSIA because it was not collected within the specified period, ADEPSIA contacts the customer to determine the next steps for the order.
If the customer requests a new dispatch and the return results from their failure to collect the parcel or an address error attributable to them, they may be charged the new dispatch costs.
ARTICLE 8 – LIABILITY FOR DELIVERY
Where the carrier is offered by ADEPSIA, ADEPSIA remains responsible to the consumer for the proper performance of delivery under the conditions provided for by regulations.
The risk of loss of or damage to the product transfers to the customer when they, or a person they have designated, take physical possession of the product.
The fact that a carrier's tracking marks a parcel as delivered does not automatically deprive the consumer of the opportunity to report a delivery problem.
In the event of a lost or damaged parcel or any irregularity, the customer is encouraged to contact the following address promptly:
stating their order number and, where useful, attaching photographs.
ARTICLE 9 – DAMAGED, INCORRECT OR NON-CONFORMING PRODUCTS
The customer is encouraged to inspect their order upon receipt.
If the product received is damaged, defective or does not match the product ordered, the customer can contact ADEPSIA at:
It is recommended that the customer provide the order number and photographs that help identify the problem.
This procedure helps the request to be handled but does not limit the consumer's statutory guarantees.
ARTICLE 10 – STATUTORY RIGHT OF WITHDRAWAL
In accordance with the French Consumer Code, the consumer generally has 14 days from receipt of their product to inform ADEPSIA of their decision to withdraw, without having to give a reason for that decision.
The request can be sent to:
or by post:
ADEPSIA – Adrien Savoyat
13 rue François Truffaut
78540 Vernouillet
France
The customer can also use the model withdrawal form at the end of these Terms.
After informing ADEPSIA of their decision to withdraw, the customer has the applicable statutory period to return the product.
The direct return costs are payable by the customer, except where ADEPSIA expressly decides to cover them or where regulations provide otherwise.
ARTICLE 11 – UNSEALED COSMETIC PRODUCTS AND HYGIENE
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised, in particular, for goods that have been unsealed by the consumer after delivery and cannot be returned for hygiene or health protection reasons.
Where an ADEPSIA product has an inner seal, a seal or a protective device intended to preserve its integrity and hygiene, this must therefore remain intact where the conditions of this statutory exception are met.
A cosmetic product is not automatically excluded from the right of withdrawal solely because it is a cosmetic.
ARTICLE 12 – RETURN PROCEDURE
The right of withdrawal must be exercised within 14 days of receiving the product, under the conditions set out in Article 10. After notifying ADEPSIA of their withdrawal, the customer has 14 days to return the product.
No additional commercial extension of this period is offered. Returns result in a refund; commercial exchanges are not offered.
The conditions for products unsealed for hygiene reasons remain those set out in Article 11. The statutory guarantees set out in Article 14 remain applicable.
To request a return, email contact@adepsia.fr with the order number and the product concerned, then follow the instructions provided by ADEPSIA.
Return address: ADEPSIA
13 rue François Truffaut
78540 Vernouillet
France
The customer bears the direct costs of return following withdrawal, unless otherwise agreed or applicable regulations require ADEPSIA to bear them.
ARTICLE 13 – REFUNDS
Where a right of withdrawal is validly exercised, ADEPSIA refunds the amounts due under the conditions and within the time limits provided for by regulations.
Where required by law, the refund includes the original delivery costs corresponding to the least expensive standard delivery method offered by ADEPSIA.
Where the customer voluntarily chose a more expensive delivery method than the standard method offered, the corresponding additional cost does not have to be refunded in the cases provided for by regulations.
ADEPSIA may withhold the refund until the products have been received back or until the consumer provides proof of their dispatch, whichever is earlier.
The refund is made using the same payment method as that used for the order, unless the customer expressly agrees to another method being used without additional charges.
ARTICLE 14 – STATUTORY GUARANTEES
Products sold by ADEPSIA benefit from the applicable statutory guarantees.
14.1 Statutory guarantee of conformity
ADEPSIA is required to deliver a product that conforms to the contract.
The consumer benefits from the statutory guarantee of conformity under the conditions provided for in Articles L.217-3 et seq. of the French Consumer Code.
For the products concerned, the seller is liable for any lack of conformity that becomes apparent within two years of delivery of the goods.
Where the statutory conditions are met, the consumer may, in particular, request that the product be brought into conformity and, where this is impossible or cannot be done under the conditions provided for by law, benefit from a price reduction or termination of the contract.
14.2 Guarantee against hidden defects
The consumer also benefits from the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
These statutory guarantees apply independently of the commercial returns policy offered by ADEPSIA.
For any request:
ARTICLE 15 – RETENTION OF TITLE
ADEPSIA retains ownership of the products ordered until their price has been paid in full.
However, the transfer of risk takes place in accordance with the mandatory provisions of the French Consumer Code applicable to sales concluded with consumers.
ARTICLE 16 – LIABILITY
ADEPSIA is responsible for the proper performance of its obligations under the conditions provided for by applicable legislation.
ADEPSIA cannot be held liable, in particular, where non-performance results from a fault on the customer's part or an event meeting the characteristics of force majeure within the meaning of French regulations.
No provision of these Terms is intended to or has the effect of excluding any liability or guarantee that could not lawfully be excluded to the detriment of the consumer.
The customer must comply with the instructions for use and precautions stated for ADEPSIA products.
ARTICLE 17 – INTELLECTUAL PROPERTY
The website adepsia.fr and its text, photographs, illustrations, visuals, graphic elements, logos, distinctive signs and content are protected by the applicable intellectual property rules.
The brand and elements identifying ADEPSIA may not be reproduced, exploited or used without permission where such permission is legally required.
ARTICLE 18 – PERSONAL DATA
ADEPSIA processes certain personal data necessary, in particular, to manage orders, payments, deliveries, returns, customer relations and, where the customer has consented or regulations permit it, certain marketing communications.
Detailed information about the processing carried out, Shopify, Klaviyo, Judge.me, Microsoft Clarity, cookies and individuals' rights is presented in ADEPSIA's Privacy Policy available on adepsia.fr.
Any request relating to personal data can be sent to:
ARTICLE 19 – EVIDENCE AND ELECTRONIC COMMUNICATIONS
Information recorded in the computer systems of ADEPSIA and its providers may constitute evidence of orders, payments and communications between ADEPSIA and the customer, within the limits provided for by regulations.
The customer is encouraged to retain order and dispatch confirmation emails.
ARTICLE 20 – CONSUMER MEDIATION
In the event of a problem with an order, the customer is encouraged to contact ADEPSIA first to seek an amicable solution:
06 18 34 69 96
After a prior written complaint to ADEPSIA that has not resolved the dispute, the consumer may refer the matter free of charge to the consumer mediator responsible for ADEPSIA.
Consumer mediator: [TO BE COMPLETED AFTER MEMBERSHIP]
Address: [TO BE COMPLETED]
Website: [TO BE COMPLETED]
This information will be completed once ADEPSIA has effectively joined a listed consumer mediation scheme.
ARTICLE 21 – APPLICABLE LAW AND DISPUTES
These Terms are governed by French law.
This provision does not deprive a consumer residing in another country of any more protective mandatory provisions applicable under regulations.
In the event of a dispute, ADEPSIA and the customer are encouraged to seek an amicable solution first.
The consumer may then use the competent consumer mediator and retains the right to bring proceedings before the competent courts in accordance with the applicable rules.
ARTICLE 22 – AMENDMENTS TO THE TERMS
ADEPSIA may amend these Terms, in particular to reflect changes in its business, services or regulations.
The conditions applicable to an order remain those accepted by the customer when that order was confirmed.
